1. Acceptance of Terms

By downloading, installing, or using the NeuroPace mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

NeuroPace is a sensory-reset aid that offers low-stimulation experiences to help calm sensory overload. The App provides:

• Guided breathing animation (Breath Reset)
• Low-stimulation visual ripples (Visual Reset)
• A visual hourglass focus timer (Focus Timer)
• White noise and binaural-beat audio with waveform visualization (Sound Reset)
• An adjustable sensory profile that scales animation/audio intensity
• A local session history, deep links, and an optional home-screen widget

3. Not a Medical Device

The App is not a medical device. It cannot diagnose, treat, cure, or prevent ADHD, autism, sensory-processing disorder, or any other medical condition. Nothing in the App constitutes medical advice. Always consult a qualified medical professional for medical concerns.

4. User Responsibilities

You are responsible for:

• Using the App in a safe environment and at a comfortable volume/intensity
• Stopping use if you experience discomfort, dizziness, or distress
• Maintaining the confidentiality and security of your device and data
• Ensuring your use of the App complies with applicable laws

5. Audio, Photosensitivity & Safe Use

Sound Reset plays audio and Visual Reset displays soft, non-flashing motion. If you have photosensitive epilepsy, hearing sensitivity, or a similar condition, consult a medical professional before use and adjust intensity/speed settings accordingly.

6. Subscriptions & Payments

The current version of the App is provided free of charge and has no in-app purchases. If premium features are introduced in the future, these Terms will be updated and any purchase will be processed through the Apple App Store and subject to Apple's terms.

7. Intellectual Property

The App, including its design, code, animation, and bundled audio (excluding user-generated content), is the intellectual property of NeoSpark Tech. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User Content

You retain all rights to the data you create within the App. Because NeuroPace is a local-first application, your sensory profile and session history remain on your device and are not transferred to us.

9. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's functionality
• Use automated systems to access or interact with the App

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL NEOSPARK TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
